The purpose of the present general terms and conditions of sale is to define the legal relationship between the company "Speck-Sports" (hereinafter referred to as "Speck") and any individual of legal age or holding parental authorization (hereinafter referred to as "the customer") wishing to visit the website or make a purchase on the website www.speck-sports.com (hereinafter referred to as "the site").

Any dispute between Speck-Sports and another party is subject to French law. Failing amicable resolution with a consumer mediator, the dispute will be brought before the Commercial Court of Mulhouse.

2. The offer

The products offered for sale by Speck are described textually and presented visually with the greatest accuracy. However, the products as illustrated by photo may differ slightly from the products ordered.

Speck is free to modify or withdraw each product offered on the site. The offer is valid while stocks last. However, the availability of products may depend on the store's stock update. Consequently, any confirmed order may contain an unavailable product. Speck undertakes to inform and reimburse the customer as soon as possible.

3. Prices

Prices are displayed on the site in euros, pounds sterling or Swiss francs, inclusive of all taxes applicable in France. Taxes may be added to the price depending on the country of delivery of the product.

The prices in force are those displayed in the shopping basket at the time the order is placed. Speck reserves the right to modify its prices at any time and without prior notice. However, price changes can only be applied to orders placed after the price change. We regularly carry out maintenance work on the website, which may result in pricing errors. In this case, the order cannot be honored and we will contact you to cancel the order as soon as possible.

Prices, including any promotional offers or discounts, are valid only for orders placed on the site.

All orders shipped outside the European Union and French overseas departments and territories will automatically be invoiced exclusive of tax, except for orders delivered to the United Kingdom. Import formalities, customs duties and any taxes relating to the delivery of an item outside the European Union and French overseas departments and territories are the sole responsibility of the customer. They must be paid to the competent authorities in the country of delivery. The customer is solely responsible for verifying the possibility of importing the products ordered under the laws of the country of delivery. Speck-Sports is not obliged to check and inform the customer of applicable customs duties and taxes. Speck-Sports advises the customer to check with the relevant authorities in his or her country. 4. Order

To place an order, the customer must be of legal age or have parental consent. The ordering process is as follows:

-selection of items and addition to basket

-the customer enters his/her personal details (surname, first name, date of birth, delivery address, e-mail address) or creates/connects to a customer account, if applicable

-choice of delivery method for the address entered by the customer (the choice of delivery method may vary depending on the product) and acceptance of the general terms and conditions of sale

-choice of payment method among those proposed to the customer (the choice of payment method may vary according to the country of delivery). Opening of a redirection page to the secure payment system, if applicable

-confirmation of the order by Speck by email and on the website

Validation of the order commits the customer and implies an obligation to pay. The conclusion of the contract is effective only after the sending of the confirmation email to the email address provided by the customer when entering his personal data or when creating the account. The transfer of ownership of the product takes place when full payment of the product price has been made. Speck reserves the right to refuse to honour an order from a consumer who has not paid in full or in part for a previous order, or with whom a payment dispute is still pending.

5. Payment

Speck offers various secure payment methods for orders. When customers are in the shopping basket, they can select a payment method directly after entering their delivery details. Only payment methods compatible with the customer's country of delivery are offered. 5.1. Payment by Fintecture instant transfer

The customer can pay by secure instant transfer via Fintecture, which is approved by the Banque de France. This payment method is only available to customers residing in France, Spain and Italy.

5.2. Payment by credit card

It is possible to pay by credit card if the card is a Carte Bleue, Visa or MasterCard. The total amount of the basket is debited from the card as soon as the order is validated. The security of the transaction is guaranteed by Monetico Paiement.

5.3. Payment by bank transfer

The customer may pay for his purchase by bank transfer from his bank. This method of payment is available for all countries except France, Spain and Italy. Depending on the processing time of the bank transfer, the order may take longer to process. However, the order will be processed as soon as the bank transfer has been received.

5.4. Payment by PayPal

Customers can pay for their purchases via their PayPal account. This allows the customer not to give Speck-Sports their bank details.

6. Delivery

After validation of the order, the products are delivered to the delivery address entered by the customer during the ordering process. In the event of an error in the delivery address, the customer must notify customer service as soon as possible. Speck cannot be held responsible for the impossibility of delivery.

In the event of delivery of a damaged or non-compliant product, the customer is invited to refuse delivery. By signing the carrier's delivery note, the customer acknowledges receipt of the package in good condition.

For orders delivered in Metropolitan France for less than €100, delivery charges are payable by the customer, depending on the delivery method chosen. The delivery times indicated at the time of ordering are indicative and may vary according to product availability, any problems encountered by the carrier or weather conditions.

If an item is delivered to a "pickup point" and returned to sender at the end of the delivery period, a return charge of €4.99 will be deducted from the refund.

7. Right of withdrawal

In accordance with articles L. 221-18 to L. 221-28 of the French Consumer Code, the customer has a right of withdrawal of 14 days from the day following receipt of the goods. If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

8. Product returns and exchanges

Customers have 14 days from the date of purchase to request a return and obtain a refund. Customers residing in Metropolitan France are responsible for return shipping costs up to €4.99. These costs will be deducted from the refund. If the customer uses a method other than the one provided by us, the return costs will remain at the customer's expense.

To make a return, customers must log in to their customer account and click on "Return request". A returns form will then be provided. This must be attached to the parcel, and the parcel must be dropped off at a Pick Up point.

The customer will be reimbursed once the return has been received, and this will take place within 14 days of the return being processed at our premises.

Customers living outside mainland France are responsible for their own return shipping costs. They must return the product to Speck-Sports by their own means, with a photocopy of the invoice in paper format.

The product must be returned new, in its original packaging, labelled, unused and complete. The customer must ensure that the product is not damaged in transit. The product's return packaging must not be taped to the original packaging, nor may the original packaging be used as a shipping carton. Speck reserves the right to refuse a refund or exchange if the product is damaged, either by the customer or by improper return packaging.

In accordance with article L221-28 of the French Consumer Code, the following items cannot be returned:

-goods made to customer specifications and personalized (e.g. drilled skis, cut sealskins, thermoformed shoes, etc)

-goods likely to deteriorate or expire rapidly (e.g. foodstuffs)

The customer must also return products offered as part of a promotional operation.

9. AFTER-SALES SERVICE

Products sold by Speck are covered by the manufacturer's warranty. This warranty is subject to normal use of the product. Speck will contact the manufacturer to ensure that the problem is dealt with as quickly as possible.

To benefit from the product warranty, it is essential to keep the product purchase invoice.

To make an after-sales service request, customers must log in to their customer account on the website. Then click on "After-sales service request". This will take you to an after-sales service form.

The customer must provide several photos of the product, a photo of the serial number, and a photo of the purchase invoice. Upon receipt of the request, Speck will forward these elements to the brand, which will establish an initial diagnosis. Speck will get back to the customer to provide further details. If necessary, the defective product will have to be returned at Speck's expense, who will then forward the product to the manufacturer. Speck follows the instructions of the brand policy for after-sales service requests.

10. Protection of personal data

In accordance with the French Data Protection Act 78-17 of January 6, 1978, the customer has the right to access and rectify any personal data he or she has provided to Speck. Data collected by Speck is for internal use only. The customer may at any time request to exercise his right to be forgotten by deleting his data. The customer may unsubscribe from newsletters and other marketing information at any time.

To exercise his rights, the customer may contact Speck at any time.

11. Warranties

Products sold by Speck are subject to the legal guarantee of conformity, in accordance with articles L.217-3 to L.217-32 of the French Consumer Code. They are also protected by the law on hidden defects guaranteed by articles 1641 to 1649 of the French Civil Code.

In the case of the legal warranty of conformity, the customer has 2 years from the date of delivery to report a defect deemed to have existed at the date of delivery. The customer then has the choice between replacing or repairing the product, free of charge.

12. Settlement of disputes

In accordance with article L.612-1 of the French Consumer Code, in the event of a dispute, the customer may have recourse to a consumer mediator for an amicable resolution.

Consumer mediation is a process for resolving disputes amicably, before legal action is taken. The solution proposed by the consumer mediator is not binding on the parties concerned. However, before having recourse to the mediator, the consumer must first have tried to resolve the conflict with the professional.
